Mini-market owner fined RM5,000 for profiteering on sale of cooking oil


IPOH: The owner of a mini-market was fined RM5,000 by the Sessions Court here today for profiteering over the sale of cooking oil.

Judge Ainon Shahrin Mohamad handed down the sentence to Mini Market Desa Rishah Sdn Bhd, represented by its director, J. Shanker, who pleaded guilty to the offence. Shanker paid the fine.

According to the charge sheet, the company sold or offered for sale a two-kilogram bottle of cooking oil at a price higher than the one set by the Controller, in violation of Sections 4, 5, or 7 of the Price Control and Anti-Profiteering Act 2011.

The offence was allegedly committed at Mini Market Desa Rishah Sdn Bhd, Taman Klebang Ria in Chemor, on April 17 at 12.30pm. It falls under Section 11 of the Price Control and Anti-Profiteering Act 2011 and is punishable under Section 18(b) of the same Act.

According to the facts of the case, an inspection revealed that the business had sold the 2kg pack of cooking oil at RM13.90, exceeding the maximum allowed price of RM13.30, constituting an offence under the Act.

The offence carries a fine not exceeding RM100,000, imprisonment for a term not exceeding three years, or both. For a second or subsequent offence, the penalty is a fine not exceeding RM250,000, imprisonment for a term not exceeding five years, or both.

Perak Domestic Trade and Cost of Living Ministry prosecuting officer N. Shamani appeared for the prosecution, while Shanker was represented by lawyer Ahmad Shamil Azad Abdul Hamid.
