Hearing of SRC International's lawsuit against Najib delayed to November

KUALA LUMPUR: The hearing of a lawsuit filed by SRC International Sdn Bhd against Datuk Seri has been postponed to Nov 6 as there were no witnesses available to testify.

Lawyer Kwan Will Sen told High Court judge Justice Raja Ahmad Mohzanuddin Shah Raja Mohzan that Ihsan Perdana managing director Datuk Dr Shamsul Sulaiman, who was expected to testify on Monday (Oct 13), could not come to the court as he was hospitalised.

He said the witness had furnished the plaintiff with a medical certificate and a photo, proving that he was hospitalised due to Influenza A.

“The fear is there are potential complications to his heart, and he is currently undergoing medical procedures,” the lawyer said.

The next witness, former SRC International director Datuk Suboh Md Yasin, was in Johor and would only be able to testify in the afternoon, Kwan said.

Justice Raja Ahmad, however, said that rushing the witness could affect his preparations to testify and that the court also had another case scheduled later in the day.

He urged parties to be mindful of their witnesses and plan their availability more efficiently.

The court then adjourned the proceedings to Nov 6.

In May 2022, SRC International and its subsidiary Gandingan Mentari Sdn Bhd filed the lawsuit against Najib, accusing him of breach of fiduciary duties, knowing receipt of funds, dishonest assistance, tort of misfeasance and abuse of power in relation to the misappropriation of SRC International funds.

The plaintiffs are seeking a court declaration that Najib is liable to them for receiving RM42mil and claiming damages for the knowing receipt, dishonest assistance, tort of misfeasance and abuse of power.
