JERTIH, Nov 4 — A teacher has been sentenced to 10 years in prison and six strokes of the cane for committing physical sexual assault on a 15-year-old male student.
Judge Ahmad Fadhli Mahmud meted out the sentence on Anuar Yusoff, 48, after finding him guilty of the offence.
Anuar was charged with three counts of committing the offence and was sentenced to 10 years in prison with two strokes of the cane on each count, to be served concurrently from today.
“The court also ordered the accused to undergo counselling during his imprisonment and to be placed under police supervision for two years after completing his prison sentence,” said the judge.
Ahmad Fadhli, when reading out the judgment, said that after examining the evidence and arguments presented by the defence and prosecution, the court found that the defence had failed to raise any reasonable doubt in the case and that the defence made was a mere denial.
“Taking into account the accused as a teacher who should protect the victim and not take advantage of the victim to indulge his lust, especially when the victim is of the same sex.
“However, the accused betrayed the trust given to him by committing sexual acts on the victim and such acts have left the victim traumatised,” he said.
Anuar was charged with three counts of committing physical sexual assault on the 15-year-old boy in a room at a resort on Pulau Perhentian at 3pm on July 29, 2022 and 1am and 5am on July 30, 2022.
The charge was brought under Section 14 (a) of the Sexual Offences Against Children Act 2017, which provides a maximum prison sentence of 20 years and caning, if convicted.
Deputy Public Prosecutor Muhammad Akmal Mohd Jazlee appeared for the prosecution, while Anuar was represented by lawyer Nik Ismail Nik Lah. — Bernama
