KUANTAN: A police sergeant’s appeal against his conviction and sentence for accepting bribes was dismissed by the High Court here today, which upheld his 14-month jail term and RM10,000 fine.
Judge Datuk Mohd Radzi Harun ruled that the conviction of Mohd Ridhuan Kasah, 45, from the Pekan district police headquarters, was safe and supported by the evidence presented at trial.
Mohd Ridhuan had been found guilty by the Kuantan Sessions Court on March 10, 2022, on two counts of soliciting and receiving bribes under Section 17(a) of the Malaysian Anti-Corruption Commission (MACC) Act 2009.
According to the facts of the case, the accused accepted RM1,000 in cash from a man, Syed Mohd Firdaus Syed Hussin, at the Criminal Investigation Department office of the Pekan district police headquarters at 5pm on Sept 18, 2020.
The money was meant as an inducement for him not to take legal action against the complainant.
The following day, on Sept 19, 2020, he received another RM1,000 from the same individual for the same purpose at Pekan Station 2 in the town centre around 12.30pm.
In his decision today, Mohd Radzi upheld the conviction and sentence for the second charge, affirming the original decision of the Sessions Court.
The court ordered that Mohd Ridhuan begin serving his 14-month prison sentence immediately and pay the RM10,000 fine.
He was not granted leave to appeal further.
Deputy public prosecutor Dr Ifa Sirrhu Samsudin appeared for the prosecution, while Mohamad Hamizey Mat Taib and Halimaton Saadiah Abu Samah represented the accused.
