KOTA KINABALU: The contractor responsible for the Tun Fuad Stephens Botanical Garden redevelopment project in Bukit Padang has been fined RM2704.61 for each day’s delay in completion of the works bringing the total amount owed to RM281,279.44.
The penalty, imposed under the Liquidated Ascertained Damages (LAD) clause, amounts for 104 days, effective July 15 this year.
In a statement today, Kota Kinabalu City Hall (DBKK) said the fine will remain in force until all construction works are fully completed according to the specified standards and requirements.
Despite the ongoing works, DBKK announced that the Tun Fuad Stephens Botanical Garden will reopen to the public from Monday (Oct 27) following a comprehensive safety and progress assessment.
The decision was made after a recent Brisk Walk Pre-Opening programme to evaluate the safety and suitability of the jogging routes.
“The inspection found that the construction activities along the jogging track no longer involve heavy works and are now focused on finishing and complementary tasks,” DBKK said.
With that, the main jogging track and several hiking trails will reopen to the public, subject to adherence to safety rules and guidelines set by DBKK.
However, Hiking Trail No. 2 will remain closed as it passes through the Botanical Centre area, where active construction is still ongoing.
The park’s operating hours are from 6am to 7pm daily, taking into account that certain areas within the park remain under construction.
DBKK said several sections of the garden will stay closed for safety reasons.
These include the Botanical Centre, Commercial Plaza, Boardwalk and Lake Walk, Conservatory Park, Bamboo Corner, and Herb Garden.
“The public is strictly prohibited from entering restricted areas. DBKK will not be responsible for any accidents or injuries resulting from trespassing,” it said.
In the meantime, DBKK is installing new signage, safety notices, and directional indicators throughout the park to enhance visitor safety and convenience.
The city hall urged the public to cooperate fully by following safety instructions and maintaining cleanliness at the site.
