Ex-TH Plantations CEO files unfair dismissal complaint


KUALA LUMPUR: Former TH Plantations Bhd chief executive officer (CEO) Mohamed Zainurin Mohamed Zain has filed a complaint of unfair dismissal with the Industrial Relations Department (IRD) after the company failed to respond to his appeal.

His lawyer, Marwan Abdullah, said this followed the company’s failure to reply to an appeal letter challenging the termination, despite assurances from TH Plantations chairman Datuk Dr Ahmad Kushairi Din in an Aug 29 email that a response would be issued.

“Since TH Plantations Bhd has failed to respond to our client’s appeal letter within a reasonable timeframe, we are further instructed by our client that he has exhausted the internal process in challenging his termination.

“Our client had lodged a complaint of unfair dismissal under Section 20(1) of the Industrial Relations Act 1967 at the Industrial Relations Department Kuala Lumpur today, seeking reinstatement as the TH Plantations Bhd CEO,” he said in a statement today.

He said the IRD has scheduled a reconciliation session between Zainurin and the company on Oct 30, before Ibrahim Ishak.

As a subsidiary of Lembaga , Marwan said, the dismissal was not only “without just cause or excuse” under the law, but also against the Islamic principles.

“We urge TH Plantations Bhd to give their full cooperation during the reconciliation stage at the IRD to settle this matter for the sake of TH Plantations Bhd.’s shareholders, in particular Lembaga , which serves approximately nine million depositors throughout the nation,” he said.

In a filing with Bursa Malaysia, TH Plantations confirmed that Zainurin’s contract was terminated on Aug 26, citing misconduct.

Zainurin had been CEO since Oct 1, 2021.
