Muda has lodged a police report against the Malaysian Anti-Corruption Commission and its chief commissioner, Azam Baki, over the agency’s alleged failure to act on purported graft cases in Sabah.

The report was filed at the Dang Wangi police headquarters here today by acting Muda president Amira Aisya Abd Aziz, who was accompanied by Lawyers for Liberty director Zaid Malek.

Amira claimed that MACC had failed to take comprehensive action on alleged corruption cases despite there being sufficient evidence to warrant an investigation.

She questioned whether MACC was engaging in selective prosecution and leaving certain people “untouched”.

The Puteri Wangsa assemblyman said the police report was intended to compel an investigation into MACC’s alleged negligence, and Azam’s role in that.

“What I find most unreasonable is when Azam, as MACC chief, did not speak up or take any action on (Sabah businessman) Albert Tei’s complaint. That is a betrayal of the sacred duty he holds,” she said.

Zaid said the report was filed under Section 217 of the Penal Code, which deals with the failure of a public servant to carry out his duties.

He said MACC was also bound by Sections 7 and 11 of the MACC Act to investigate all corruption reports, and added that it had failed to do so despite receiving videos and documents supporting Tei’s claims.

The Sabah mining scandal surfaced last year following the release of several videos purportedly of discussions involving bribery and misconduct related to mineral exploration in the state.

Sabah assistant industrial development and entrepreneurship minister Andi Suryady Bandy and Sindumin assemblyman Dr Yusof Yacob have claimed trial to receiving RM150,000 and RM200,000 in bribes, respectively, involving mineral prospecting licence applications.

Tei has, meanwhile, claimed trial to two charges of giving the bribes.

MACC has repeatedly stated that Tei does not qualify for whistleblower protection as he was allegedly involved in the offence he reported.
