Na'imah wins bid to refer legal questions to High Court


KUALA LUMPUR: Toh Puan Na’imah Abdul Khalid today succeeded in her bid to refer eight legal questions in connection with her failure-to-declare-assets case.

High Court judge K. Muniandy allowed the application after overturning the Sessions Court’s earlier decision, which had dismissed it.

Na’imah, the widow of former finance minister Tun Daim Zainuddin, had filed the appeal following Sessions Court judge Azura Alwi’s rejection of her application on the grounds that it lacked merit, as no constitutional issues were raised.

On Feb 29 last year, Na’imah, 68, filed an application at the Sessions Court to refer legal questions concerning Sections 30(5), 36(2) and 62 of the MACC Act, as well as Section 32(3)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act, to the High Court.
