Audit chief not a civil servant when appointed, says AGC

The appointment of Wan Suraya Wan Mohd Radzi as auditor-general is above board as she was no longer a member of the civil service, the Attorney-General’s Chambers said today.

The AGC said that Wan Suraya relinquished all other roles in the federal service when she was appointed to her post as auditor-general on June 13, 2023. Wan Suraya was no longer a member of the Administrative and Diplomatic Service at the time.

However, as auditor-general, she continues to be a member of the general public service, as stated in the Audit Act.

“Since her appointment as auditor-general was in order, there is no need for her to be retired,” the AGC said in response to queries about the legality of her appointment.

Former law minister Takiyuddin Hassan had raised the matter in the Dewan Rakyat, and said Wan Suraya’s appointment was not in line with the Federal Constitution.

Speaking during the debate on the 2025 Auditor-General’s Report, Takiyuddin said the auditor-general’s appointment should be independent of the public services.

He said the Federal Constitution stated that the auditor-general is paid out of the consolidated fund. “I believe this means that the post of auditor-general cannot be held by someone still in the public services,” he said.
