Federal Court reinstates ‘annoyance’ offence in communications law

The Federal Court has reinstated a provision in the Communications and Multimedia Act that criminalises content that “annoys” or is “offensive”, the two words the Court of Appeal struck down last year.

A five-member panel led by Chief Justice Wan Ahmad Farid Wan Salleh unanimously ruled the words did not violate freedom of speech under Article 10(1) of the Federal Constitution.
