
A company director has been charged in the Kuala Terengganu sessions court with misusing company funds to pay her husband without approval.
A2 Wax Sdn Bhd director Nor Atiqah Alwi pleaded not guilty after 10 charges were read before judge Zul Zakiqudin Zulkifli on Oct 27, the Companies Commission of Malaysia (SSM) said in a statement.
Nor Atiqah was slapped with nine charges under Section 218(1)(a) of the Companies Act 2016 of misusing A2 Wax’s assets by approving payments to her husband, Fakrullah Rahim, without the consent or ratification of the company’s general meeting between 2021 and 2022.
She was also charged under Section 221(1) of the same Act with failing to declare her interest during a board of directors’ meeting which approved a contract appointing her husband as a freelance contractor.
The court set Nov 27 for case mention to allow the prosecution to submit the relevant documents, and granted bail of RM20,000 with one surety.
Prosecution was conducted by SSM prosecuting officer Tengku Nor Zurairah Tengku Abdul Aziz while Nor Atiqah was represented by lawyer Hazman Harun.
In its statement, SSM said the legal action served as a reminder to the corporate community and the public to comply with the Companies Act 2016.
