KUALA LUMPUR: Segambut Bersatu deputy chief Adam Radlan Adam Muhammad was freed by the court after paying a compound of RM4.1 million.

Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said, citing information from the Office of the Chief Registrar of the Federal Court, said that during the case mention, the Malaysian Anti-Corruption Commission (MACC) deputy public prosecutor informed the court that Adam Radlan had been offered a compound under subsection 92(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (Amla).

He subsequently paid the compound on Aug 18.

“Following this, the prosecution applied to the court under subsection 254(1) of the Criminal Procedure Code (CPC) to withdraw all charges, and an order of discharge not amounting to acquittal (DNAA) was granted to the accused.

“In this matter, the prosecutor exercised his discretionary power to discontinue proceedings against the accused,” she said in a parliamentary written reply to a question from Tan Kar Hing (PH-Gopeng).

He had asked about the basis of the Sessions Court’s decision and the deputy public prosecutor’s agreement that led to the discharge and acquittal of Adam Radlan from 12 charges of corruption and money laundering related to the Jana Wibawa project after he paid the compound.

Azalina added that Article 145(3) of the Federal Constitution confers discretionary authority upon the public prosecutor to initiate, conduct or discontinue any proceedings for an offence.

“Furthermore, counsel for the accused argued that the accused should be granted an order of acquittal and discharge.

“After considering the submissions of both parties, the Sessions Court judge decided to discharge and acquit the accused under subsection 254(3) of the Criminal Procedure Code,” she said.

Adam Radlan had faced 12 charges, comprised five for corruption under Section 16(a)(A) of the MACC Act 2009 and seven for money laundering under Amla.
