KUALA LUMPUR: Datuk Seri Anwar Ibrahim has filed a striking out application on Hindraf chairman P. Waytha Moorthy’s legal bid challenging his election as the Tambun MP and his subsequent appointment as the Prime Minister.
The striking out application, filed on Oct 10, was on the grounds that Waytha Moorthy’s suit was filed out of time.
In the court documents, Anwar claimed that the originating summons was unsustainable, frivolous, vexatious, and an abuse of court process.
He is also seeking for all proceedings relating to the suit at the High Court to be stayed pending the disposal of his striking out application.
On Aug 14, Waytha Moorthy filed the lawsuit seeking a court declaration that Anwar‘s 2018 royal pardon did not exempt him from the five-year constitutional disqualification imposed on individuals convicted of criminal offences.
He is seeking a court declaration that Anwar’s election as Tambun MP on Nov 19, 2022, and his subsequent appointment as prime minister five days later as null and void.
The Attorney General’s Chamber responded to the suit, saying there was no issue with Anwar’s appointment, as the pardon by the 15th Yang di-Pertuan Agong was a full pardon where the prime minister is as a person who had never committed any offence.
On Oct 6, Waytha Moorthy also filed an application to refer two related questions of law for the Federal Court’s determination.
Both Anwar and Waytha Moorthy’s applications are fixed for case management on Oct 28.
