PETALING JAYA: A coalition of women’s rights organisations has strongly criticised Kelantan police chief Datuk Mohd Yusoff Mamat for suggesting that girls involved in “consensual” underage sex cases should also face charges.
The Joint Action Group for Gender Equality (JAG) stressed that the remark was harmful as it reinforced victim-blaming narratives and ignored the best interests of children, which are enshrined in the Child Act 2001.
“Children in Malaysia are fully protected under the law, which stresses that any action concerning a child must prioritise their best interests,” JAG said in a statement today (Sept 24).
It pointed out that cases involving underage sexual activity are investigated under Section 376 of the Penal Code (rape) and Section 14 of the Sexual Offences Against Children Act 2017, where girls are typically recognised as victims.
“To call for girls to be charged contradicts both the law and child protection principles, showing a lack of understanding of the law and the urgent need for education and prevention,” the group added.
JAG further stressed that police officers, being the first point of contact for survivors, must be sensitive to children’s rights and gender perspectives.
“Making such a suggestion in a press conference is inappropriate, as it shifts focus away from protection and education,” it said.
The group urged the government to ensure senior police officers are properly trained on child rights, gender perspectives, and prevention measures.
It called for mandatory training in child-centric reporting to ensure cases are handled fairly, transparently, and in accordance with the law.
“A systemic approach that includes child education, community awareness, and stronger social protection must be prioritised to effectively address and prevent underage sexual activity,” JAG said.
Mohd Yusoff made the remark on Sept 21 while commenting on statutory rape cases.
The Home Minister later clarified on Sept 23 that it was his personal view and not government policy.
